Pickleball Central Coast–TERMS and CONDITIONS

In these terms & conditions:

Terms means these Terms & Conditions

Pickleball Central Coast means Pickleball Central Coast, ABN: 80446245519

Event/s means any class, league, tournament or course operated by Pickleball Central Coast

Venue/s means any facility, court or location where Pickleball Central Coast operates

Participant/s means any person participating in a Pickleball Central Coast Event

 

PARTICIPATION

1. By participating in any Pickleball Central Coast Event, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you must not participate in any Event.

 

2. As a condition of entry, a Participant accepts these Terms and any rules, policies or procedures that may be adopted by Pickleball Central Coast from time to time. Pickleball Central Coast may change, amend or vary these terms and conditions and may extend the period of, or cancel, the Event without notice.

 

3. In the case of any inconsistency between these Terms and any promotional material, these Terms prevail.

 

4. Pickleball Central Coast provides Pickleball Events across Venues on the Central Coast of NSW, Australia. Pickleball Central Coast does not operate any Venues that Events are held.

 

5. Your participation at any Event may be subject to additional rules, policies, conditions or waivers as specified by the Venue where Pickleball Central Coast Events are held and therefore not captured within these Terms.

a) If you do not agree or comply with these additional requirements, the Venue or Pickleball Central Coast may restrict your attendance at that Event.

b) For any information regarding the Venues Terms, please seek this information directly with the Venue.

 

HEALTH & SAFETY

6. Pickleball Central Coast undertakes every action to ensure a Participants safety at participating Venues for their Events. By attending, Participants must understand there are certain risks in participating in sport and recreational activities, and that games will have varied skill level, intensity, and weather conditions.

 

7. By participating in an Event, you agree that you are aware of these risks which include, but not limited to, personal or property damage, illness and bodily injury or death. You acknowledge that some of these risks cannot be eliminated, and you assume the risk of injury or harm. You acknowledge and agree that it is your responsibility to consult with your primary care physician prior to participating and to determine if and how participating in any Event will affect you personally.

 

8. To the fullest extent permitted by law, you release, indemnify, and hold harmless Pickleball Central Coast, and each of their respective officers, directors, members, employees, consultants, contract employees, representatives and agents, and each of their respective successors and assigns, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages and liabilities (including for ordinary negligence and the application of any of the provisions of Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law) arising out of or in any way related to your participation in an Event, including with respect to bodily injury, physical harm, illness, death or property damage.

 

9. To protect the health and safety of all Participants, in the instance that a Participant falls ill with coronavirus, Participant agrees that they will not attend an Event. This includes:

a) If the Participant has tested positive for coronavirus on the day of the Event, or within 14 days prior to the Event

b) If the Participant is required by their State Government law to be in quarantine or isolation

c) If the Participant is a close contact to a coronavirus case

 

For more information regarding coronavirus and your duties as a Participant at an Event, please refer to your State Government website.

 

10. Pickleball Central Coast does not provide reimbursement of medical expenses for injuries sustained while participating in Events. Participants are encouraged to take out their own Private Health, Life and Income Protection insurance in accordance with their own needs and circumstances.

PERSONAL INFORMATION & USE OF IMAGES

​11. Pickleball Central Coast collects Participants’ personal information in order to conduct the Event.

 

12. Participants agree to your personal information (name, phone number and contact details) being collected at the time of Event registration and being used for:

a) Purpose of Event administration

b) Provide you information on the Event

c) Notify you of future Events which may be of interest to you

 

13. If the information requested is not provided, the Participant may not be permitted to participate in the Event.

 

12. Pickleball Central Coast may use images and videos recorded of you at Events for use at Pickleball Central Coast’s discretion within any form of media. Social Media posts may also include Participants name and game results as well as reference to any Event for advertising, community building, promotions or otherwise, for no fee or remuneration to the Participant.

 

13. A request to access, update or correct any information should be directed to Pickleball Central Coast.

 

14. Participants personal information is safeguarded by Pickleball Central Coast to protect privacy and confidentiality of all details.

 

15. Participants are responsible to ensure that their contact details with Pickleball Central Coast are up to date.

 

GENERAL

16. Pickleball Central Coast has the right to take any action deemed necessary in the best interests of all Participants and all decisions relating to discipline are final.

17. Participant agrees to the Code of Conduct, available on Pickleball Central Coast website.

18. Pickleball Central Coast will make reasonable effort to communicate all event changes to entrants but reserves the right to make any alterations to Events, without notice.

 

19. Decisions made by Pickleball Central Coast will be final and no correspondence or disputes entertained.

 

20. By participating in Events you confirm that you have read and understood the terms and conditions of the Event and that you agree to be bound by these terms and conditions.
